Short-Term Rental Agreement

This agreement governs a temporary guest stay at The Onyx at Luray. The reservation confirmation supplies the particular dates, prices, taxes, and guest count. The separate Onyx Liability Waiver supplies the pool and property safety terms and must be accepted by the booking guest before arrival.

1. Parties and reservation

Owner: 6097 S Page Valley LLC, a Virginia limited liability company (Owner). Booking guest: the person identified in the reservation confirmation (Guest). Guest must be at least 21 years old, remain responsible for the reservation, and provide accurate contact and guest information. The property is the vacation home known as The Onyx at Luray, located near Luray, Virginia (Property). The Property’s street address is provided in the reservation confirmation.

The reservation confirmation is incorporated into this agreement for arrival and departure dates, nightly charges, applicable taxes, approved guests and pets, and the total payable. This is a temporary lodging reservation for the stated dates, not a transfer of ownership or a right to occupy beyond checkout. Any extension requires written approval and payment.

2. Occupancy and visitors

The nightly rate includes up to five overnight guests. Guests six through eight cost $50 per additional guest, per night. Eight is the maximum overnight occupancy. Guest must identify the correct number of adults and children and obtain written approval before changing the count. Only registered guests may use the Property or pool. Day visitors, events, parties, commercial uses, and gatherings require prior written approval; approval of a visitor does not increase the overnight limit. Guest is responsible for all persons admitted by Guest.

3. Stay and payment

Check-in is after 4:00 p.m. and checkout is by 10:00 a.m. Eastern time unless Owner agrees otherwise in writing. Most stays require at least two nights; major holidays and peak fall weekends require three nights as shown at booking. The reservation price includes the displayed nightly rates, a $325 cleaning fee, approved pet charges, extra guest charges, and applicable taxes and other amounts itemized before confirmation.

For a booking made more than 30 days before arrival, 50% of the reservation total is due at booking and the remaining balance is due 30 days before arrival. For a booking made 30 days or less before arrival, the entire total is due at booking. The reservation is confirmed only when the required payment is processed and confirmation is issued. Guest authorizes the agreed charges through the booking payment method, subject to the processor’s terms. If a scheduled balance payment fails, Owner may request prompt payment and may cancel the reservation if it remains unpaid after written notice and a reasonable opportunity to cure, subject to applicable law and the cancellation terms below.

4. Guest cancellation and refunds

Guest may cancel through the booking system or by written notice to Owner. The following percentages apply to amounts paid for the reservation, including mandatory fees and taxes to the extent refundable under law, with no refund exceeding amounts actually received. Any nonrefundable third-party processing charge must be disclosed before booking if it will be withheld.

The 48-hour full-refund rule controls when both of its conditions are met. After that window, the applicable days-before-check-in tier controls. Owner will return any refund to the original payment method. A change of dates is subject to availability and written approval; if approved, the parties will state in writing whether the original booking date or new booking date controls cancellation eligibility.

5. Owner cancellation and interruptions

If Owner cannot provide the Property for reasons within Owner’s control, Owner will refund amounts paid for unavailable nights and related unused charges, or Guest may accept a mutually agreed substitute arrangement. Owner does not promise reimbursement of travel or other outside expenses except as required by law. For an interruption, unsafe condition, or amenity outage during a stay, Guest must notify Owner promptly and allow reasonable access and time to address it. Any remedy or refund will depend on the circumstances and applicable law; no provision limits nonwaivable rights.

6. Pets and property care

Up to two pets are permitted only with prior approval and disclosure in the booking. The pet charge is $149 per pet, per stay. Guest must control pets, clean up waste, prevent damage or disturbance, and comply with applicable law. No pets may enter the pool. Assistance animals will be handled as applicable law requires.

Guest will leave the Property reasonably tidy, follow checkout instructions supplied before departure, and promptly report damage, injury, hazards, or equipment failures. The cleaning fee covers ordinary turnover cleaning. Guest is responsible for documented, reasonable costs caused by Guest or the party beyond ordinary use, including excess cleaning, missing items, and damage to the house, furnishings, pool, equipment, or grounds. Owner will provide an itemized explanation and supporting documentation before charging additional amounts, subject to applicable law and any payment-platform process.

7. Conduct and amenities

Guest must follow posted instructions and the separate Onyx Liability Waiver. Pool hours are 8:00 a.m. to 10:00 p.m.; no lifeguard is on duty. Children require the supervision and life-preserver precautions described in the waiver. No diving, swimming alone, glass near the pool, intoxicated swimming, or tampering with pool systems. The waiver states a maximum of ten people in the pool at one time; that safety limit does not authorize unregistered visitors or more than eight overnight guests.

No smoking, vaping, candles, or open flames inside the house or pool house or near pool mechanical equipment. Fires and grilling are allowed only in designated outdoor areas, subject to burn bans and waiver rules. No fireworks, accelerants, reckless conduct, excessive noise, or disturbance of neighbors. Guest must comply with applicable laws and reasonably posted Property rules supplied before the stay, including the House Rules.

8. Access and enforcement

Owner may enter for an emergency, necessary repair or safety concern, or other lawful reason, with reasonable notice when practicable. Guest must not disable safety devices or interfere with maintenance. For a material breach, Owner may require corrective action, deny use of an affected amenity, or terminate the stay to the extent permitted by law. Any removal, refund, additional charge, or possession remedy will be handled under applicable law; this agreement does not authorize unlawful self-help or an automatic forfeiture of amounts that law requires to be refunded.

9. Waiver and allocation of risk

The Onyx Liability Waiver, Assumption of Risk, and Indemnification Agreement is incorporated by reference and requires Guest’s separate electronic or written acceptance. In a conflict about amenity safety, the waiver’s more specific safety rule controls; this agreement controls booking prices, payment, cancellation, and occupancy. Neither document waives a right or imposes liability beyond what Virginia law permits. Guest must ensure the party knows and follows the rules.

10. Communications and general terms

Reservation notices and cancellation requests may be sent through the booking system or to the contact address stated in the confirmation. Guest must keep a working email address and phone number on file. This agreement, the reservation confirmation, the waiver, and rules supplied before booking comprise the parties’ agreement. A material change requires written consent. If a provision is unenforceable, the balance remains effective to the extent allowed by law. Virginia law governs, and any action will be brought in a court with jurisdiction over the Property, subject to applicable law. Electronic signatures and acknowledgments may be used.

11. Acceptance

Guest accepts this agreement electronically by checking the acceptance box before payment at checkout. By doing so, Guest confirms receipt of this agreement and the reservation confirmation, agrees to these booking and house terms, and separately acknowledges and accepts the Onyx Liability Waiver. The booking system records the booking guest’s name, the reservation number, the stay dates, the number of guests and pets, and the date and time of acceptance, and a copy of the reservation details is sent to Guest by email.
